Fire Safety & Evacuation of Buildings Regulations

The History of the Regulations
The new regulations came into force on 1 January 1995 replacing the 1970 regulations. If your building already has an evacuation procedure you comply with regulation 5 (see below ). If you think that this achieves compliance with the regulations, please refer to the explanatory note on page 18. There are 23 regulations, and the most important regulations are the fire safety (preventative) regulations in Part 1.
The Part 1 regulations apply to all buildings except ordinary dwellings and farm buildings. In the case of new buildings an application must be made within one month. Schemes once approved must be updated and fresh approval sought in the case of building alterations, changes in the scheme, change of use of the building, where the life of the building has been extended, or where an application for subdivision is made.

When must I have an evacuation scheme?

PART II EVACUATION SCHEMES - IF YOUR BUILDING MEETS ANY OF THE FOLLOWING CRITERIA, AN APPROVED (REGISTERED) EVACUATION SCHEME WILL BE REQUIRED

BUILDINGS WITHOUT SPRINKLERS
100 or more people are able to be present for different purposes or activities.(ie halls, function rooms)
Where facilities for employment are provided for more than 10 people (whether self employed or employed by one or more people).
Where accommodation is provided for more than 5 people.(ie motels, boarding house, farm stays)

Where 100 or more people can gather for a common purpose.
Where hazardous substances are stored or processed.
Where early child care facilities are provided.
Where specialised nursing, medical or geriatric care is provided.
Where specialised care is provided for people with disabilities
Where people are in lawful detention.
EXPLANATORY NOTE:  All buildings in New Zealand except houses and farms Need Formal Fire Procedures All buildings with more than 10 positions for employment - or with dangerous goods (where a permit is required) - or where 100 persons can gather - or accommodation facilities without sprinklers - or nursing or childcare facilities as above Need a Formal Evacuation Scheme (approved by NZ Fire Service)
